1. Introduction

Welcome to 888eTrade. These terms and conditions govern the use of our application and the services we provide. By using our application, you agree to comply with these terms and conditions.

2. Definitions

  • Application: 888eTrade
  • User: Any person who accesses and uses the application.
  • Store: Vendors who use the application to sell products.
  • Subscriber: Users who have subscribed to additional services provided by the application.

3. Acceptance of Terms

By registering and using our application, you agree to these terms and conditions. If you do not agree with any part of these terms, you should not use the application.

4. Modifications of Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes through the application or via email. Continued use of the application after such changes constitutes acceptance of the new terms.

5. User Registration and Account

You must register to access certain features of the application. It is your responsibility to maintain the confidentiality of your account and password. You must immediately notify us of any unauthorized use of your account.

7. Payment Policy

We accept various payment methods, including credit and debit cards. Prices are subject to change, and we will notify users of any changes in advance. We are not responsible for additional fees that may be charged by external payment providers.

7.2 Platform Fee

A fee of 17.88% will be applied to the total sales made through the platform. This fee will be automatically deducted from each completed transaction.

7.3 Additional Fees

Users should be aware that additional fees may apply from payment processors and bank transfers. These fees are not included in the 17.88% fee mentioned above and may vary depending on the payment service provider used.

7.4 Price Adjustment

We recommend that hosts, businesses, and affiliated merchants adjust the prices of their products and services to account for the fees associated with using the platform, payment processing, and bank transfers.

7.5 Payments Outside the Platform

888eTrade SRL does not permit payments outside the platform, such as direct transfers, cash payments, or any other external payment method. If payments are made outside the platform, both the Host and the Guest will lose protection in case of disputes and may be indefinitely banned from the platform.

7.6 Currency of Payment

All payments and transactions will be processed in USD (U.S. Dollars).

7.7 Payments to Hosts

Payments to Hosts will be made 24 hours after the service and/or product purchased through the platform has been provided. Payments are subject to the terms of the transaction and may be delayed in case of disputes or delivery issues.

8. Cancellation Policy

8.1 Cancellation by the Guest

The Guest has the right to cancel their purchase or service under the following conditions:

  • Cancellation up to 8 days in advance: The Guest will receive a full refund of the amount paid, minus any transfer fees applicable.
  • Cancellation between 7 and 4 days in advance: The Guest will receive a 50% refund of the amount paid, minus any transfer fees applicable.
  • Cancellation within 3 days or after the service has been provided: No refund will be issued.
8.2 Cancellation by the Host

If the Host cancels the purchase or service without reasonable justification, the full purchase amount will be refunded to the Guest. In addition, 888eTrade SRL will apply a 30% penalty of the amount paid by the Guest to the Host, which must be paid within 3 business days via the platform's;s available payment methods.

8.3 Exceptions to the Cancellation Policy

In exceptional cases, such as natural disasters (earthquakes, hurricanes, floods, etc.), force majeure events, or documented emergencies, both the Guest and the Host may agree to an alternative solution, such as rescheduling the service or purchase. In these cases, transfer fees will apply if required by financial institutions or payment processors.

8.4 Cancellation by the Host with Justified Cause

If the Host cancels the purchase or service for justified reasons, such as health issues, unforeseen problems, or similar situations that can be verified, no penalty will be applied. In this case, the Guest may choose to reschedule the service or receive a full refund of the amount paid, minus any transfer fees applicable.

9. Use of the Application

You must use the application legally and ethically. You may not use it for fraudulent or illegal activities. We reserve the right to suspend or delete your account if you violate these terms.

10. Relationship Between Stores and Users

Stores are responsible for their products and services. Users should contact stores directly for any issues related to their purchases.

11. Intellectual Property

The application is owned by 888eTrade SRL and is protected by intellectual property laws. You may not copy, distribute, or modify any content without our express permission.

12. Limitation of Liability

The application is provided "as is" and "as available." We will not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of the application.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the application or violation of these terms.

14. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

15. Termination

We may terminate or suspend your access to the application at any time, with or without cause, with or without prior notice.

16. Governing Law and Jurisdiction

These terms will be governed by and construed in accordance with the laws of Costa Rica and/or the country where the service and/or products are provided. Any disputes will be resolved in the competent courts of Costa Rica.

18. Acceptable Use Policy (AUP)

18.1 Purpose

The Acceptable Use Policy (AUP) outlines the rules and restrictions for using our application. Its purpose is to ensure that the application is used in a legal, ethical, and responsible manner.

18.2 Prohibited Activities
  • Corruption and Bribery: Participation in corruption, bribery, or fraudulent practices is not allowed.
  • Human Trafficking and Exploitation: Using the application to facilitate or promote human trafficking is prohibited.
  • Drugs and Illegal Substances: The sale, distribution, promotion, or use of illegal drugs is not permitted.
  • Minors: The application must not be used to promote or facilitate products or services inappropriate for minors.
  • Prostitution and Sexual Services: The promotion of prostitution or sexual services is prohibited.
  • Illegal Content and Activities: Any other content or activities that are illegal are prohibited.
18.3 Detection of Violations

We use various methods to detect violations of this AUP, including monitoring for keywords, user reports, and activity audits.

18.4 Procedures for Violations

If a violation is detected, we may notify the vendor or user, suspend or delete accounts, and take legal actions when necessary.

18.5 Review and Modifications

We reserve the right to review and modify this AUP at any time. Continued use of the application after changes to the AUP constitutes acceptance of the new terms.

We are committed to maintaining a safe and ethical platform. Vendors and users are expected to comply with local laws and respect the rights of others.
